去年签的，到11月2号过期。 如果10月中旬回国，可以马上去签证吗？还是必须等到签证过期之后才可以？ I797是到2012年九月前有有效。 谢谢～～

Yes. I just did the same thing. Previous H1 visa stamp expires on Oct. 30th. Submitted my new H1 application through CITIC bank in Beijing on Oct. 9th. New H1 visa issued on Oct. 18th without any issue. Came back US on Oct. 23rd using the new one.
